"Blue Lobster Pipes" – General Terms and Conditions of Trade

1. A return privilege is granted to buyers in Germany or abroad, in accordance with § 321 d BGB [German Civil Code], provided that the persons in question are consumers. The purchased article can be returned to "Blue Lobster Pipes" irrespective of reason. The aforementioned right is to be exercised within a period of 14 days of receiving the goods. The time limit begins upon the arrival of the goods, and is regarded as observed when goods are returned within the set period. After the return of the article "Blue Lobster Pipes" will reimburse the purchase price and also – if business was transacted within Germany – any postage incurred. Postage costs shall be carried by the buyer in the case of foreign business.

2. "Blue Lobster Pipes" affirms that it only supplies unused goods which are free from quality defects. The buyer shall effect compensation for the value of the goods, if he has damaged them, or put them to use prior to returning them. Pipes which have been smoked are regarded as having been put to use. In this case, compensation of at least 50% of the purchase price is, as a rule, to be effected.

3. The buyer's right to subsequent performance or revocation of contract shall remain unaffected, subject to the proviso that "Blue Lobster Pipes" shall be entitled to choose the replacement should the buyer demand supply of a faultless article. "Blue Lobster Pipes" processes natural products, with the effect that it is impossible to deliver identical goods; instead compensation of an appropriate kind and quality is effected. Burn-throughs only constitute a defect of quality if they result from a material defect or poor workmanship, but not if they are the result of irregular initial use or handling on the part of the buyer.

4. "Blue Lobster Pipes" delivers on the basis of cash in advance. Ordered items are dispatched to the buyer immediately after receipt of payment. The place of performance is Düsseldorf, otherwise §447 BGB shall apply. Should a period of more than two weeks expire between ordering and receipt of payment "Blue Lobster Pipes" is entitled to revoke the contract and resell the ordered article. Special explanations and deadlines are not required in this case.
